TERMS & CONDITIONS - Please read completely and sign below, before booking your session.
1. It is understood that Lori R McCoy is the exclusive, official photographer of bella vita photography and she will perform all photographic services requested on this Contract.
2. Session fees must be paid at the time the session is booked. Your session time will not be reserved for you without session fee payment. For this event only, bella vita photography will donate $35 of every paid session fee to Big Brothers Big Sisters of Butler County.
3. Session time is up to 30 minutes and will accommodate groups of up to 10 people. If your group includes more than 10 people, you must book and pay for two consecutive session times. This allows the photographer sufficient time to work with everyone and still ensure good expressions, lighting and variety in posing for the larger group. Groups of more than 10 people that book a single session time will not be served and forfeit the session fee paid at the time of booking.
3. No part of any order, including digital images, will be delivered until the order balance has been paid in full.
4. bella vita photography reserves the right to use images created under this contract for advertising, display, publication, education or other purposes. The Client signing this Contract warrants that he or she has the actual authority to agree to the use of the likeness of all persons included in the portrait in this manner and shall indemnify and defend bella vita photography in the event of litigation arising out of such use.
5. Negatives, digital files and previews remain the exclusive creative property of Lori R. McCoy/bella vita photography, and all copyrights shall be held by the creator in perpetuity. It is ILLEGAL to copy or reproduce negatives, digital images and printed photographs elsewhere without bella vita photography's permission, in the form of a Print Release, and violators of this Federal Law are subject to its civil and criminal penalties.
6. CANCELLATION: Session fees and deposits are non-refundable; however, at the discretion of bella vita photography, if you are unable to keep your scheduled session, due to illness or other catastrophic emergency event, you may be allowed to transfer the session fee to a future session. Transfer fees may apply. You must provide at least 24 hours notice if you will be unable to keep your session time.
7. Exclusively for this event, bella vita photography is offering online password-protected galleries to view your session images and purchase your products. You will receive an email notification with password to your gallery as soon as your gallery goes live. The gallery will remain open for 7 calendar days. All ordering and purchasing decisions must be made during that time. If you are unable to complete your order within 7 calendar days, you must request a gallery extension at a cost of $25/day.
8. The discounted price list offered with the Give & Get Family Portrait Special is exclusive to this event. You must place and pay for your order within 15 days of your gallery posting to receive the discounted pricing. Product orders placed more than 15 days after your gallery expires are subject to bella vita photography's standard pricing list, which can be viewed on our website at http://www.bellavita-photo.com.
9. ALL SALES ARE FINAL. Once you place your order, it will immediately be processed to our professional printing lab. Due to the inherent nature of custom portrait photography, no products can be returned or orders cancelled. In addition, orders cannot be changed or cancelled once you have received any digital download.
10. PRODUCT DELIVERY: If purchasing digital files, they will be available for immediate download once you pay for your order. All other products will be available for pickup within 10 business days of when you place your order. Please note we cannot guarantee Christmas delivery for orders placed after December 10, 2019.
You must pick up your order at the studio, where you will review and inspect the entire order and sign an acceptance/release form. Once you have accepted your order, there are no refunds or exchanges. If there is a quality control issue with a product, it must be addressed at the time you inspect the order. For this reason, if someone other than yourself will pick up the order, it must be an adult you have designated in writing (an email to lori@bellavita-photo.com is acceptable) to sign the acceptance/release form.
